A youth court had erred in deciding that, pursuant to the Magistrates' Courts Act 1980 s.24 , the appropriate mode of trial for a youth charged with burglary was the Crown Court as there was no real prospect of the imposition of a custodial sentence of over two years in length. The youth court on the committal hearing should have concluded that that decision was wrong and exercised their powers under s.25 of the Act to try the case summarily.
