R (on the application of R) v A CHIEF CONSTABLE (2013)

PUBLISHED September 24, 2013

[2013] EWHC 2864 (Admin)

A requirement that a man convicted of manslaughter and kidnap should provide a non-intimate DNA sample so that it could be compared with samples for unsolved crimes was lawful. Although the requirement breached the offender's right to respect for private and family life, the interference with that right was in the interests of solving crime and was proportionate.
