[2007] EWHC 639 (Admin)

The Secretary of State for the Home Department had been entitled to conclude that there was evidence of a prima facie case against an individual whose extradition was sought to the United States pursuant to the Extradition Act 1989 , that that individual would not be subject to the death penalty if extradited and that it was appropriate to extradite him.
