[2008] EWHC 1335 (Admin)

A driver's conviction for failing to provide a breath specimen was quashed where, having been given an opportunity by a police officer to provide a sample following several previous refusals, he was only given one minute of the three-minute cycle of the breath analysis device in which to provide it.
