The tribunal had erred where it had given considerable weight to personal mitigation following a finding of guilty conduct unbefitting of a solicitor. The correct approach, following the guidance in Bolton v Law Society (1994) 1 WLR 512, was to consider whether the criminal conduct was such that the maintenance of the reputation of the solicitors' profession as one that could be trusted required an individual to be struck off.
