The Vagrancy Act 1824 s.4 was to be used with caution. A youth who was discovered in an enclosed yard allegedly hiding from the police following a burglary did not have an "unlawful purpose" within the meaning of s.4 at the time at which he was found and could not therefore be convicted under that section. For there to be an "unlawful purpose", there had to be some criminal activity in mind.
