A minimum term of 3 years and 140 days was imposed on an offender who had been repatriated to the United Kingdom following her conviction for attempting to smuggle heroin, despite the fact that she had been repatriated on the basis of the Lord Chief Justice's recommendation that she would serve a minimum term of 12 years. The court was bound to apply the provisions of the Powers of Criminal Courts (Sentencing) Act 2000 s.82A and the Criminal Justice Act 2003, which was enacted after the Lord Chief Justice made his recommendation.
