[2013] EWHC 3695 (Admin)

A district judge had been entitled to conclude that a Polish citizen was a fugitive from justice, but the fact that that was a borderline decision was material when considering whether it was proportionate to extradite him to Poland to stand trial for fraud offences alleged to have occurred 18 years earlier. The Polish authorities had not done all that they could reasonably have done to find him and his extradition would not be proportionate.
