Cost appeals: remember to request formal written reasons

Important reminder about appeals to the Senior Courts Costs Office

Providers and advocates must request formal written reasons for payment refusals or part payments from the LAA when making further appeals to the Senior Courts Costs Office. 
This will follow refusals or part payments of a Litigator Fee appeal (LF2) or Advocate Fee Redetermination (AF2).
Comments made in section 4 of the LF2 form, section 5 of the AF2 form or within any accompanying covering letters do not constitute the LAA?s written reasons. 
The need to provide written reasons before applying for an appeal to the Senior Courts Costs Office is set out in regulation 28 (8) & (9) of the Criminal Legal Aid (Remuneration) Regulations 2013.
