Where police had seized a video tape as part of a criminal investigation, the chief constable had no power to retain the tape under the Police and Criminal Evidence Act 1984 s.22 when the investigation was completed despite the fact that he believed the return of the tape might lead to the owner committing a serious criminal offence.
