ATTORNEY-GENERAL'S REFERENCE (NO.86 OF 1998) SUB NOM R V ANTHONY DE ST AUBIN (1999)

PUBLISHED April 16, 1999
SHARE

A sentence of two years' imprisonment was unduly lenient for a set of convictions including wounding with intent contrary to s.18 Offences Against the Person Act 1861, assault occasioning actual bodily harm contrary to s.47 of the 1861 Act and having an offensive weapon contrary to s.1(1) Prevention of Crime Act 1953. Such an unprovoked and irrational attack as in the present case required a longer term of imprisonment.
