In determining whether there had been a miscarriage of justice according to the categories identified in R. (on the application of Adams) v Secretary of State for Justice [2011] UKSC 18, [2012] 1 A.C. 48, the Department of Justice of Northern Ireland had erred in failing to weigh new forensic evidence with all the other evidence in order to determine whether the applicant could possibly have been convicted.
