Nothing in s.102 Crime and Disorder Act 1998 prohibited the imposition of a new term of imprisonment consecutive to an order for return under s.40 Criminal Justice Act 1991. This was because the s.40 term was, for the purposes of Part II of the 1991 Act, a sentence of imprisonment which the offender was ordered to serve and from which he had not been released.
