The police did not owe an individual, who was about to be charged with a criminal offence, a duty of care in respect of psychiatric loss. On that basis, police officers had not acted in breach of a duty of care where they had mistakenly disclosed the true identity of a former criminal gang member, thereby potentially putting him in danger, which had led to his entering witness protection.
