Where it appeared that a lender had made a loan without complying with the requirements of the Consumer Credit Act 1974 and had obtained a possession order without informing the court that there were grounds on which its application would fail if the court were given the full picture, the borrower was entitled to an extension of time and permission to appeal against the possession order.
