[2012] EWHC 2978 (Admin)

An order for the immediate destruction of two dogs which had been dangerously out of control in a public place but had not caused injury to a member of the public was quashed and the matter was remitted to the Crown Court, where the court had erred in law in concluding that the dogs were a danger to public safety.
