Cases where an extraditee could satisfy a district judge that his extradition to a Category 1 country would breach his rights under the European Convention on Human Rights 1950 art.3 would be very few and would require clear, cogent and independent evidence of a type that was something approaching the international consensus in MSS v Belgium (30696/09) (2011) 53 E.H.R.R. 2.
