Imprisonment - Length of sentence - Assault occasioning actual bodily harm R v James: Court of Appeal, Criminal Division (Lord Justice Richards, Mr Justice Keith, Mr Justice Nicol): 22 September 2011 The Court of Appeal, Criminal Division, held that the judge had not erred in giving limited discount in sentence in respect of a defendant who had indicated, at an early stage, his willingness to plead guilty to an alternative count of assault occasioning actual bodily harm, but only on condition that the prosecution would not proceed with the more serious offence and where his guilty plea was not entered until the first day of trial. read more
