Whether a director had permitted the matters alleged by the secretary of state was not the statutory test for whether he should be disqualified, it was a statement by the secretary of state designed to inform him of the case against him for the purpose of obtaining a disqualification order under the Company Directors Disqualification Act 1986 s.6.
