Proceedings were instituted for the purposes of the Forestry Act 1967 s.17(2) when the information was laid and information was laid when it was received by the magistrates' court's office. The magistrates' court had been entitled to conclude that an information, which had been faxed to the court on the last day of a time limit for instituting proceedings, had been laid within time despite the fact that the information had been stamped with a later date.
