[2008] EWHC 796 (Admin)

In making a gating order in respect of a public footpath a local authority was required by the Highways Act 1980 s.129A to be satisfied that the highway was facilitating the persistent commission of criminal offences or anti-social behaviour as at the date of the making of the order and that it was, in all the circumstances, expedient to make such an order for the purposes of reducing such acts.
