In an appeal against a 12-month sentence for an offence of possession of a firearm with intent to cause fear of violence, whilst there was disparity with the non-custodial sentence passed on another offender in circumstances arising out of the same set of facts, a custodial sentence was entirely appropriate although justice would have been better served with a shorter sentence. Accordingly, the appeal was allowed and the sentence substituted with a term of six months' imprisonment.
