In order to commit fraud by false representation, a defendant had to make a false representation, as defined in the Fraud Act 2006 s.2; do so dishonestly; and to intend to make a gain or cause loss by making the representation. It was a matter for the jury as to whether the causative link between the intention and the false representation was established.
