Where there was some force in the suggestion that the prosecution could have isolated two of the more serious allegations relating to a general indictment of ill-treating a patient rather than the judge forming his own view about the factual basis of the offence, the sentence of 12 months' imprisonment was quashed and substituted with a term of nine months.
