[2004] EWCA Crim 2309
An application for leave to appeal against a conviction of possession of an explosive substance on the ground that the defendant lacked mens rea was refused as there was no requirement for the prosecution to show that the defendant possessed homemade bombs for an unlawful purpose. The sentence of nine months was manifestly excessive and was quashed with a 12-month conditional discharge substituted.
