The secretary of state's power to recall a person to prison for a breach of licence pursuant to s.39 Criminal Justice Act 1991 overlapped with and could lawfully be exercised with the court's power to recall a person to prison under s.116 Powers of Criminal Courts (Sentencing) Act 2000.
