In proceedings brought on behalf of the Society for the Protection of Unborn Children, the court rejected the contention that the prescription, supply and use of the morning after pill amounted to a criminal offence under the Offences Against the Person Act 1861 s.58 and s.59; the morning after pill could not bring about a "miscarriage" because "miscarriage" meant the termination of an established pregnancy.
