[2008] EWCA Crim 370

The Crown could invoke its right of appeal under the Criminal Justice Act 2003 s.58 provided that the relevant "acquittal agreement" had been made in good faith; the court had no role to play and in particular had no power to decide whether the acquittal agreement was objectively justified.
