[2008] EWCA Crim 1761

An asylum seeker charged with an offence under the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004 s.2(1), who had felt unable to travel with his genuine passport because of persecution in his home country, had a reasonable excuse for not having immigration documents at an asylum interview.
