PUBLISHED July 16, 1999In cases where s.40 Criminal Justice Act 1991 was invoked in order to impose sentences for breaches of unexpired licence periods, the judges were wrong to have ordered those sentences to run consecutively to sentences for the new offences and accordingly they were quashed and ordered to run concurrently.
