A failure to administer a caution before an interview at a police station amounted to a significant and substantial breach of the Police and Criminal Evidence Act 1984 Code C, but evidence of such an interview could be admitted at the discretion of the trial judge. A judge had been correct to exercise his discretion where the defendant's solicitor had been present, the interview had been recorded and the defendant's evidence from the interview was consistent with his other evidence.
