R v LEE GILL (2005)

Where offences triable either way were committed to the Crown Court for sentencing under Powers of Criminal Courts (Sentencing) Act 2000 s.3 together with summary offences committed under s.6 of the Act the Crown Court was limited to the powers of the Magistrates' Court when sentencing for the summary offence. However there was nothing wrong in making that sentence consecutive to the other sentences.
