A sentence of 24 weeks' imprisonment, suspended for two years, imposed for an offence of causing death by careless driving was manifestly excessive, and a community order involving a 100-hour unpaid work requirement would be substituted for it where, although the defendant's driving had demonstrated a momentary misjudgement placing it in the second category under the relevant sentencing guidelines, insufficient account had been taken of his guilty plea, and his culpability did not justify a custodial sentence.
