The lacuna in the law of theft created by the judgment in R v Preddy (1996) 2 Cr App R 524 could be overcome by s.5(3) Theft Act 1968 provided that it was established that the appellants were obliged to retain and deal with the property or its proceeds in a particular way and that this obligation had been breached.
