In an appeal against sentence for the conviction of manslaughter by way of gross negligence, there was an ample factual substratum between a tenant and the landlord's son for holding that a duty to take care had arisen. The fact that the appellant landlord's son had no contractual relationship with the deceased tenant was not in itself a bar to the imposition of that duty of care.
