[2010] EWCA Crim 1213

In limited circumstances, evidence from a live witness that could not be given orally for reasons other than those provided for in the Criminal Justice Act 2003 s.116 could be admitted. Ultimately, it was for the trial judge to determine the admissibility of such evidence having regard to the provisions of s.114(2).
