[2008] EWCA Crim 2915

A confiscation order made under the wrong legislation and then altered several months later to include the correct legislation was unlawful, as the variation was made after the prescribed time limit in the Powers of Criminal Courts (Sentencing) Act 2000 s.155(1). The variation therefore had to be made on appeal.
