Where an anti-social behaviour order was made which had the effect of prohibiting behaviour which would in any event be a criminal offence, the proper approach to sentencing, if the offender subsequently committed such a criminal offence and was therefore in breach of the order, was that the sentence for breach of the order should not exceed the statutory maximum for the criminal offence.
