PUBLISHED June 18, 1999A technical misdirection contained in the Judicial Studies Board Directions No.38 "Defendant's Total Or Partial Silence At Trial" had not rendered a conviction unsafe but the court referred the specimen direction to the Judicial Studies Board for them to reconsider.
