PUBLISHED March 7, 2005

A judge was justified in directing a jury to convict the appellant under the Criminal Justice Act 1988 s.139(1) where he was incapable of discharging the burden which lay on him of showing that the religious reasons proffered constituted the predominant motivation for him being in possession of the bladed instruments in question.
