[2013] EWCA Crim 1417

A sentence of nine months' detention imposed by a Court Martial on a soldier following his guilty plea to disgraceful conduct of a cruel kind was reduced to six months' detention as, although he had been involved in a joint enterprise humiliating attack on another soldier, his lesser role in the incident justified drawing a distinction between him and a co-defendant who had received the same sentence.
