A failure by a trial judge to comply fully with the JSB specimen direction on a defendant's failure to mention a defence which he later relied upon did not render a conviction for murder unsafe in circumstances where the omissions had not withdrawn any issue from the jury and the omissions could not have worked adversely against the defendant.
