[2012] EWCA Crim 1550

An application for permission to appeal against an indeterminate sentence for public protection imposed for an offence of destroying property being reckless as to whether life was endangered, and an application to admit fresh psychiatric evidence were granted where it was reasonably arguable that the offender had been sentenced on the wrong basis and that a hospital order was appropriate.
