Where there was no unfairness caused by the destruction of evidence before the defence application to examine it, and no prejudice caused by the amendment of the indictment from conspiracy charges to the substantive offence after the close of the Crown's case, convictions for causing death by dangerous driving and attempting to pervert the course of justice were safe.
