The Court of Appeal had not been wrong to order a retrial in a murder case in which it had quashed the original conviction on the ground of prosecutorial misconduct. The question of whether a retrial was required in the interests of justice was an exercise of judgment in which a number of relevant factors had to be weighed in the balance.
