The reasoning in R. v Reynolds (Michael Edwin) [2007] EWCA Crim 538, [2008] 1 W.L.R. 1075 allowed an appellate court to preserve an unlawfully imposed extended sentence in circumstances in which, had the court below considered the issue of dangerousness, it was likely that it would have imposed a sentence of imprisonment for public protection.
