In deciding pursuant to the Magistrates' Courts Act 1980 s.24 the appropriate mode of trial for a youth charged with serious sexual offences, a youth court had erred in deciding the appropriate mode of trial based on a test as to whether it was likely that a sentence of detention for substantially more than two years would be imposed rather than the appropriate test of whether there was a real prospect or possibility of a sentence of detention for two or more years being imposed.
