The Independent Police Complaints Commission did not have jurisdiction to investigate complaints of a failed asylum seeker of an assault allegedly committed by those escorting him on his enforced removal from the United Kingdom. The escorts were exercising functions under the Immigration and Asylum Act 1999 Pt VIII and the complaint was excluded from the Commission's remit by the UK Border Agency (Complaints and Misconduct) Regulations 2010 reg.3(2).
