In refusing to de-categorise a Category A prisoner who had been convicted of war crimes and genocide by an International Criminal Tribunal, the secretary of state had failed to look beyond the gravity of the offences and ask himself the right question, namely whether the prisoner was highly dangerous as at the date of his decision, or to have answered it by giving proper consideration to all the material facts and matters relevant to the determination of that issue.
