R (on the application of M) v ISLEWORTH CROWN COURT (2005)

PUBLISHED March 2, 2005

The Divisional Court had, pursuant to the Criminal Justice Act 2003 s.17, retained the jurisdiction to entertain an application for judicial review of a refusal of bail as judicial review was a prerogative remedy. The test as to whether bail had been correctly refused had to be on Wednesbury principles robustly applied.
