The Divisional Court had, pursuant to the Criminal Justice Act 2003 s.17, retained the jurisdiction to entertain an application for judicial review of a refusal of bail as judicial review was a prerogative remedy. The test as to whether bail had been correctly refused had to be on Wednesbury principles robustly applied.
